Bauer Hockey, Ltd and its subsidiaries (“Bauer Hockey”, "Bauer”, “we” or “us”) values your trust and is committed to respecting the privacy rights of our customers and visitors (“you”, “your”, “yours”) to this website (se.bauer.com) (the “Site”) and related apps, including the Bauer App, which we own and operate. The following “Privacy Policy” describes the personal data we collect about you through the Site, the apps, our offline interactions, and explains how we use, protect, process, share, or retain your information, and describes your rights and the choices you have relating to your personal data, as data controller, as defined by the Regulation 2016/679 (the “GDPR”). This Privacy Policy is not a contract. For the purpose of this Privacy Policy, Bauer Hockey Ltd, a Canadian Company located at 700-55 Standish Crt Mississauga, ON, L5R 4B2 Canada is the data controller. Bauer Hockey Ltd has designated Bauer Hockey AB as its representative in the European Union.

We strive to manage privacy rights consistently, but some privacy rights may only be available to residents of certain localities or jurisdictions. In particular, if you are a resident of the European Union, we will process your personal data in compliance with GDPR If you are a BAUER employee, please refer to our Employee Privacy Policy. If you are a job applicant, this Privacy Policy applies to you.

WHAT IS PERSONAL DATA?

When we use the term “Personal Data” we mean the information that identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, to you or otherwise defined under applicable laws. Subject to GDPR, it does not include anonymous information or personal data rendered anonymous.

WHAT PERSONAL DATA DO WE COLLECT AND HOW DO WE COLLECT IT?

PERSONAL DATA WE COLLECT DIRECTLY FROM YOU

Contact and Account Information. We collect Personal Data from you when you register an account, order products, respond to a survey, enter a contest or sweepstakes, respond to a marketing message, use our customer service, join or comment on our social media sites, or for one of our retailers, if you sign a credit application with us, or otherwise provide us with your information. We collect from you information, such as your contact information (name, e-mail address, and telephone number) mailing and billing address, date of birth, website username and password and truncated financial account information.

Order and Product Information. When you order, purchase, return, get sized for or use our products or services we collect Personal Data from you, such as truncated payment information, purchase history, product purchases, product sizing information, player information and other information we request from you or you provide to us, including information used to facilitate the processing of your orders, warranty requests or images of your body which we use to gather measurements on appropriate product sizes, as described in the “Game Fit Equipment Measurement and Performance Technology” below.

Communications Information. When you sign up for marketing emails or text messages or communicate with us on our social media platforms, communicate to us through customer service, communicate with us as a retailer or business partner or otherwise make inquiries about Personal Data we collect from you may include your name, email, and cell phone number.

Customer Service Information. For support or product issues you may provide us with product or injury information. We do not collect your injury information without your consent or unless you provide it to us voluntarily.

Information You Post. We may collect Personal Data you post in a public space on our properties, such as ratings and reviews and user generated content.

Employment Information. When you apply for a job with us, we may collect Personal Data from you, such as your education, verifying your identity, confirming your work authorization, and other employment related information. On a voluntary basis we may collect information, such as race, disability status, veteran status and ethnicity.

PERSONAL DATA THAT WE COLLECT THROUGH AUTOMATED MEANS

Device and Online Activity Information: Like many websites, we collect Personal Data from you through automated means across several websites, apps and devices using tracking technologies. The tracking technology is further described in the “Cookies and Similar Technologies” section below. We collect Personal Data through these technologies such as online identifiers, IP address, device ID and operating system, and online activity, shopping history, browsers that you are using, websites that you came from, type device that you are using, where you downloaded our app and how often you use it, browsing activity, other app usage, referring websites, and links clicked and other analytics data.

Geolocation Information: When you use our store locator, we collect from you imprecise geolocation information from your device.

PERSONAL DATA WE COLLECT ABOUT YOU FROM THIRD PARTIES

We also collect information about you from Third Parties. We may receive Personal Data about you from social media networks, including Facebook, Twitter, TikTok, Instagram and You Tube, our digital advertising networks, or our business partners, such as an online identifier or whether you read our ads. GAME FIT and FIT LAB: EQUIPMENT MEASUREMENT AND PERFORMANCE TECHNOLOGY

BAUER offers body/gear, helmet, skate and stick measuring and performance tools that can help you find your product size or “game fit” and suit your style of play. These tools can be accessed through our Site at se.bauer.com or some tools and applications are available through the Apple Store or Google Play as downloadable mobile applications. These tools are also available through retailers that distribute our products, who may use the tools to help you find great fitting equipment.

When you use our body measurement app, it provides you with the option to either manually enter body measurements or to have a photograph or video taken of your clothed body that is processed automatically, by the measurement application and used to allow a computer program to determine your size and suggest products that best fit your body.

You control how and when the photographs and videos are taken. We use your device camera to take the photographs and blur your facial features. You agree that any photograph or video you provide shall not be pornographic, lewd or otherwise offensive to members of BAUER, and we reserve the right to refuse access to our mobile services to any user who provides such photographs or videos.

With our Game Fit technology, BAUER offers performance skate and stick tools to improve your game based upon your skating and ice play needs. BAUER also offers helmet fit tools that scan your head for a more complete fitting experience. Some photographs will be captured as part of this technology, so our retailers may ask you for consent to use this technology. With our Fit Lab technology, BAUER uses scanning technology to identify unique qualities of your feet to recommend equipment, like skates and skate orthotics. 

Children under the age of 18 are not permitted to use BAUER'S online body measurement tools or performance tools. Children under the age of 18 may be fitted in a store if their parent or guardian consent.

When a sales associate uses measurements at a store or performance data in a store, he or she will only use those measurements or performance data to recommend products that fit your body, either by inputting those measurements into a computer program or by manually estimating an appropriate fit or product.

HOW DO WE USE YOUR PERSONAL DATA?

We use information that we collect about you or that you provide to us, including any Personal Data:

• To present our Site and its contents to you.
• To provide and improve our products and services.
• To fulfill orders, validate payments, and allow for repeat ordering.
• To process warranty requests or locate shipments.
• To allow us to better service you and respond to your customer service requests.
• To understand your needs and preferences.
• To communicate with you about our products, services, and promotions.
• To determine your eligibility for jobs or certain products and services.

Your Personal Data will be disclosed, shared or sold for the purposes set forth herein or in accordance with applicable laws and in particular GDPR. We may disclose anonymized data about our users, without restriction.

We may also disclose, share, as defined under applicable laws, your Personal Data to others under the following limited circumstances:

• To our family of subsidiaries and affiliates within the Peak Achievement Athletics Inc. family of companies on a need-to-know basis.
• To contractors, service providers, and other processors we use to support our business and who are bound by contractual obligations to keep Personal Data confidential and use it only for specific purposes for which we disclose it to them.
• To a buyer or other successor in interest in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of BAUER Hockey’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which Personal Data held by BAUER about our Site users is among the assets transferred.
• To cooperate with law enforcement officials, comply with any court order, law or legal process, including to respond to any government or regulatory request.
• To third parties and business partners to protect against or detect fraud.
• To third parties and business partners for their business, marketing or advertising purposes, such as with social media sites when you respond to an ad there or advertising networks.
• To third parties that you direct us to share your Personal Data with.
• To third parties and business partners, if we believe disclosure is necessary or appropriate to enforce or apply our Terms of Use and other agreements and/or enforce the rights, property or safety of BAUER, our customers or others or to comply with applicable laws and regulations.

HOW DO WE PROTECT YOUR PERSONAL DATA?

We use a variety of technical, administrative and organizational security measures, including encryption of data, to maintain the safety of your Personal Data. Despite our efforts, no website, mobile application, or computer system is 100% secure or “hacker proof” so we cannot guarantee your information will never be accessed, used, or disclosed without authorization. We have taken certain steps designed to reduce the risk that the Personal Data that you provided to us will be misused, lost, disclosed or altered.

Right of Data Portability. You have the right to request and have us transfer to another entity your Personal Data to in a machine readable format to the extent technically feasible. This right only applies when the processing of your Personal Data is based on your consent or on a contract and such processing is carried out by automated means.

Right to Restrict or Object to Processing: You have the right to restrict or object to processing of your Personal Data when such processing is based on the legitimate interest of BAUER. We may, however, invoke compelling legitimate grounds for continued processing. You also have the right to object at any time to the processing of your Personal Data for marketing purposes. To unsubscribe from our marketing communications you may also use the above channels or simply by clicking on the “unsubscribe” link at the bottom of each communication.

If you have consented to any processing activities involving your Personal Data, you can withdraw this consent at any time for future processing. Such withdrawal will not affect the lawfulness of the processing prior to consent being withdrawn. Verification. For us to process certain requests, we will need to verify your identity to confirm that the request came from you. We may contact you by email to verify your request. Depending on your request we may ask you for additional information so that to verify your identity. If we cannot verify your identity we cannot respond to your request.

DATA RETENTION

We retain your Personal Data only for as long as we need it to fulfill the purposes for which it was collected and to comply with our legal obligations. We will generally store Personal Data associated with your account until it is no longer necessary to provide services to you, until you ask us to delete it, or until your account is deleted, whichever comes first; but there are some exceptions to this general rule. We will retain information from deleted accounts to comply with the law, prevent fraud, resolve disputes, troubleshoot problems, assist with investigations, enforce our agreements, and take other actions permitted by law. DATA TRANSFERS

Note that your Personal Data will be processed by Bauer Hockey Ltd, a company located in Canada. Canada is deemed to offer an adequate level of protection of Personal Data as per the EU Commission decision of adequacy.

CHILDREN

This Site is not intended for children under 18 years of age. No one under the age 18 may provide any Personal Data to or on the Site. We do not knowingly collect Personal Data online from children under the age of 18. If you are under the age of 18 you should not provide any Personal Data to us and you should use this Site only with the participation of a parent or guardian. Please note that if, while attempting to register on our Site or provide information through an app, a user provides us with their date of birth indicating that they are under the age of 18, the system will reject the submission.

GAME FIT och FIT LAB: TEKNIK FÖR MÄTNING OCH PRESTANDA AV UTRUSTNING

BAUER erbjuder mätverktyg för kropp/utrustning, hjälm, skridsko och klubba samt prestandaverktyg som kan hjälpa dig att hitta din produktstorlek eller "game fit" som passar din spelstil. Vissa fotografier kommer att tas som en del av denna teknik, så våra återförsäljare kan be dig om samtycke för att använda denna teknik. Verifiering. För att vi ska kunna behandla vissa förfrågningar måste vi verifiera din identitet för att bekräfta att begäran kom från dig. Observera att dina Personuppgifter kommer att behandlas av Bauer Hockey Ltd, ett företag beläget i Kanada. Kanada anses erbjuda en adekvat skyddsnivå för Personuppgifter i enlighet med EU-kommissionens beslut om adekvat skyddsnivå.
